Your use of levelupwriter.com (the “Site”) and the services made available on the Site (the “Services”), including the LevelUp Writer writing platform, is subject to these Terms of Service (the “Terms”).

By accessing or using the Site or any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations.

Velocia may revise these Terms and any other information contained on the Site at any time without prior notice. When we do so, we will revise the “Last Updated” date above. It is your responsibility to review these Terms periodically. The then-current version of these Terms will supersede all earlier versions. Your continued use of the Site or Services after such changes have been published constitutes your acceptance of the revised Terms.

Velocia may also make improvements or changes in the Services described on the Site at any time without notice.

LICENSE TO USE OUR SERVICES

Subject to these Terms, Velocia grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal or educational use. Your right to use the Services is limited by all terms and conditions set forth in these Terms.

Except for your pre-existing rights and the license granted herein, Velocia owns all right, title, and interest in and to the Site and Services, including all text, graphics, design, software, interfaces, and other elements of the platform (collectively, “Velocia Content”), excluding User Content as defined below.

Velocia Content is protected by copyright, trademark, trade dress, patent, and other intellectual property laws. You may not reproduce, distribute, modify, reverse engineer, create derivative works from, publicly display, republish, or otherwise exploit the Services or Velocia Content except as expressly permitted by these Terms.

ACCESS TO OUR SERVICES

Velocia does not provide you with the equipment required to access the Services. You are responsible for all charges associated with your internet access and any other third-party services required to use the Site.

Velocia reserves the right to modify, suspend, or discontinue any portion of the Site or Services at any time without notice. Velocia will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

Velocia also reserves the right, in its sole discretion, to refuse, restrict, suspend, or terminate your access to the Services at any time, with or without notice, if Velocia believes that you have violated these Terms or that your use of the Services presents legal or operational risk.

RESTRICTIONS

You must comply with all applicable laws when using the Services. Except as expressly authorized by Velocia or permitted by applicable law, you agree that you will not copy, distribute, sell, sublicense, scrape, reverse engineer, or otherwise exploit the Services or Velocia Content.

You further agree not to use automated tools, robots, spiders, or scraping mechanisms to access the Site or Services. You may not circumvent security measures, interfere with the operation of the platform, or attempt to gain unauthorized access to any portion of the Services.

ELIGIBILITY

You must be at least thirteen (13) years of age to use the Services.

If you are under eighteen (18) years old, you may only use the Services under the supervision of a parent, legal guardian, teacher, or educational institution.

If the Services are used within a school, classroom, or educational institution, the institution is responsible for obtaining any required parental permissions, student consents, or legal authorizations necessary for student participation.

By using the Services, you represent and warrant that you satisfy these eligibility requirements.

PRIVACY POLICY

RESTRICTED AREAS OF THE SERVICES

Certain areas of the Services may require registration and password authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify Velocia immediately if you become aware of any unauthorized use of your account or any security breach related to the Services.

USE POLICIES

You are solely responsible for any data, writing, or other material that you submit, publish, transmit, or display through the Services. You represent and warrant that you have all rights necessary to submit such content and that your use of the Services complies with all applicable laws.

You agree not to use the Services to upload, publish, or transmit unlawful, harmful, threatening, abusive, defamatory, obscene, infringing, or otherwise objectionable content.

You also agree not to upload malicious software, interfere with the operation of the Services, collect personal data about other users without authorization, or violate any local, state, national, or international law.

ACADEMIC INTEGRITY AND RESPONSIBLE USE

LevelUp Writer is designed as an educational writing assistance platform intended to help students develop writing skills through structured guidance, feedback, and drafting support.

The Services are not intended to replace independent student work or academic effort. Users remain solely responsible for the originality, accuracy, and integrity of any work submitted for academic credit.

Educational institutions, instructors, and schools determine their own policies regarding the acceptable use of artificial intelligence tools and writing assistance technologies. By using the Services, you agree to comply with the academic integrity policies of your school or institution.

Velocia does not guarantee that use of the Services will comply with the policies of any particular school, university, or educational institution and shall not be responsible for academic disciplinary actions, grading decisions, academic disputes, or institutional determinations regarding acceptable use of AI-assisted tools.

ARTIFICIAL INTELLIGENCE SERVICES

The Services utilize artificial intelligence technologies to generate writing feedback, suggestions, and educational guidance. These AI systems may process User Content in order to generate responses.

AI-generated responses may contain inaccuracies, incomplete information, or unintended results. Users should independently review all suggestions and exercise their own judgment before relying on them.

Velocia makes no warranties regarding the accuracy, reliability, or completeness of AI-generated content.

The Services may utilize artificial intelligence models provided by third-party providers, including models developed by Anthropic.

Velocia does not use User Content to train its own AI models.

WRITING CONTENT

Users retain ownership of the original writing they create using the Services (“Written Content”).

Velocia does not claim ownership of Written Content submitted by users. By submitting Written Content through the Services, you grant Velocia a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display such content solely as necessary to operate, maintain, protect, and improve the Services.

AI-generated responses produced by the Services are licensed to users for personal and educational use as part of the Services.

Velocia may use aggregated or anonymized data derived from Written Content and platform usage to improve the Services.

DATA RETENTION

Velocia may retain Written Content while a user account remains active and for a reasonable period thereafter as necessary to operate the Services or comply with legal obligations.

If a user closes their account or requests deletion, Velocia will remove Written Content from active systems within a reasonable period of time.

PAID SERVICES

Certain features of the Services may require payment of subscription fees. Payments may be processed through third-party payment providers such as Stripe.

All fees are non-refundable except where required by law. Subscription services may renew automatically unless canceled prior to the renewal date.

DISCLAIMER OF WARRANTIES

YOUR USE OF THE SITE AND SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VELOCIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VELOCIA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR RELIABLE.

NO EDUCATIONAL OUTCOME GUARANTEE

LevelUp Writer is an educational assistance tool designed to support writing development. Velocia does not guarantee academic outcomes, writing improvements, grades, or educational results resulting from the use of the Services.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Velocia and its affiliates will not be liable for indirect, incidental, consequential, or special damages arising from the use of the Services, including loss of profits, data, or academic outcomes.

Velocia’s total liability for any claim related to the Services will not exceed the greater of (a) one hundred dollars ($100) or (b) the amount paid by you for the Services during the twelve months preceding the claim.

INDEMNIFICATION

You agree to indemnify and hold harmless Velocia and its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the Services, your Written Content, or your violation of these Terms or applicable law.

DISPUTE RESOLUTION AND ARBITRATION

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration conducted in the State of Delaware in accordance with the rules of the American Arbitration Association.

You agree to resolve disputes individually and waive any right to participate in class actions.

GOVERNING LAW

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles.
